Registration Conditions


Condition 1
The designated centre shall be operated at all times in compliance with the Health Act 2007 as amended from time to time.
Condition 2
The designated centre shall be operated at all times in compliance with the Health Act 2007 (Care and Welfare of Residents in Designated Centres for Older People) Regulations 2013 and the Health Act 2007 (Registration of Designated Centres for Older People) Regulations 2015 (as amended, consolidated, restated or replaced from time to time) and in compliance with all other regulations made under the Health Act 2007 as amended from time to time.
Condition 3
The designated centre shall be operated at all times in compliance with the National Standards for Residential Care Settings for Older People in Ireland (as amended, consolidated, restated or replaced from time to time) and in compliance with all other standards made under the Health Act 2007 and as the Chief Inspector may notify to the registered provider from time to time.
Condition 4
The designated centre shall be operated at all times in compliance with all other legislation, regulations and standards which are applicable to it.
Condition 5
Subject to any prohibitions or restrictions contained in any other condition(s), the designated centre shall be operated at all times in accordance with and shall provide only the services set out in, its Statement of Purpose, as delivered and amended from time to time in accordance with Regulation 3 of the Health Act 2007 (Care and Welfare of Residents in Designated Centres for Older People) Regulations 2013 (S.I. No. 415 of 2013) (as amended, consolidated, restated or replaced from time to time).
Condition 6
No person under the age of 18 years of age shall be accommodated at the designated centre at any time.
Condition 7
The maximum number of persons that can be accommodated at the designated centre was
• 51 from February 2018 to May 2019
• 50 from May 2019 to 15 September 2019
• 49 as of 15 September 2019 on achieving compliance with condition 8
Condition 8
In order to achieve compliance the Health Act 2007 (Care And Welfare Of Residents In Designated Centres For Older People) Regulations 2013 the registered provider will implement the compliance plan submitted to the Chief Inspector on 27 June 2019 including:
(i) Bedrooms 6 on the first floor accessed by steps shall be reduced to a two-bedded room (a reduction of one resident) and reconfigured to include a full ensuite facility to include a shower, wash hand basin and toilet. The works will be completed and the reduction in resident numbers achieved by 15 September 2019.

(ii) An additional wheelchair accessible bathroom will be provided on the first floor to include a bath, toilet and wash hand basin by 15 September 2019.


This condition is to ensure that all existing and future residents are afforded appropriate dignity and privacy through the provision of adequate accessible bathroom and toilet facilities. The design and layout of the centre must be reconfigured as per plan submitted to and accepted by the Chief Inspector and within the timeframes set out in the plan.

In making this decision the Chief Inspector refers particularly to Health Act 2007 (Care and Welfare of Residents In Designated Centres For Older People) Regulations 2013 and National Standards for Residential Care Settings for Older People in Ireland; 2016
Condition 9

Room 6 (on the first floor) and rooms 23, 24 and 25 (on the second floor) which can only be accessed by steps up and down, may only be occupied by independently mobile residents who have undergone a professional assessment in relation to their safe use of the steps

Residents occupying these rooms must have ongoing professional assessment as part of their care planning process no less frequently than at four monthly intervals. In the event that the mobility of a resident occupying these rooms deteriorates the registered provider will ensure the resident is relocated to alternative more suitable accommodation

This condition is to ensure that all existing and future residents are afforded appropriate dignity and privacy through the provision of accommodation appropriate to their level of physical mobility.
