Nursing Home Appeals Withdrawn

The District Court, sitting at Dungarvan, County Waterford on 30 April 2012, heard the withdrawal of the appeals pursuant to Section 57 of the Health Act 2007 by the registered provider of St. Anne’s Nursing Home, Cashel, Co. Tipperary.

The appeals were against the decisions of the Acting Chief Inspector of Social Services of the Authority to:
1) refuse the registered provider’s application for registration pursuant to Section 50 of the Health Act 2007 and
2) cancel the registration of Margaret Ryan as registered provider of St. Anne’s Nursing Home pursuant to Section 51 of the Health Act 2007.

The registered provider withdrew her appeals against the decisions of the Acting Chief Inspector of Social Services. The Court further, and with the consent of the registered provider, made an Order in accordance with Section 64 of the Health Act 2007, directing the Health Service Executive to take charge of St Anne’s Nursing Home, Cashel, Co. Tipperary from 12.00pm on 30 April 2012 and to make alternative arrangements for the residents of St. Anne’s Nursing Home as soon as practicable.
