Nursing Home Cancellation Order Confirmed

Pursuant to Sections 59 and 60 of the Health Act 2007 as amended, an Ex Parte Interim Order was made by Carlow District Court on 21 July 2011 cancelling the registration of Avondale Nursing Home, Callan, Co. Kilkenny as a designated centre under Part 8 of the Health Act 2007.

In accordance with Section 64 of the Health Act 2007, the Health Service Executive was directed to take charge of Avondale Nursing Home from such time and to make alternative arrangements for the residents of Avondale Nursing Home as soon as practicable.

This matter then came before Carlow District Court on 2 August 2011 for the final determination of the matters dealt with in the Ex Parte Interim Order of 21 July 2011.

It was ordered by the Judge Anderson that:

  1. The registration of Avondale Nursing Home Limited as the registered provider of Avondale Nursing Home, Callan, Co. Kilkenny as a designated centre under Part 8 of the Health Act 2007 be confirmed as being cancelled and that the Ex Parte Interim Order be confirmed and made permanent in that regard, pursuant to Section 61(3) of the Health Act 2007.
  2. The Chief Inspector of Social Services of the Health Information and Quality Authority be given liberty to notify the public at large of the making of this permanent Order, to include publication on the HIQA website.
  3. Those parts of the Ex Parte Interim Order of 21 July 2011 that referred to the Health Service Executive be regarded as vacated.”
